Hindi Aco Patay (I Am Not Dead), by Juan Matapang Cruz was presented at the Teatro Nueva Luna in Malabon.
A drunk American soldier threw an empty beer bottle at the Katipunan flag used as a props and with his companions destroyed the entire scenery.
The theater manager was arrested, the play was banned and all seditious props were confiscated such as Katipunan flags and revolutionary emblems.
Cruz and ten of the actors were arrested on different dates by the authorities.
The trial became controversial because of Cruz's identity and authorities believed that it was Dominador Gomez, a labor leader who wrote the play not Cruz.
Act No. 292 or the “Sedition Act” of November 4, 1901 under Pres. Theodore Roosevelt's term, bans any advocacy of Philippine independence and making it unlawful for any person to advance orally or by writing or printing or like methods, the independence of the Philippine Islands or their separation from the United States.
